Welcome to the SkyPenguinLabs ToS - or Terms of Service document.
SkyPenguinLabs ("Company," "we," "us," or "our") provides educational courses, publications, and consultation services subject to the following Terms of Service ("TOS"). By accessing or purchasing our products or services, you acknowledge and agree to these terms in their entirety.
All courses, books, and educational materials ("Content") remain the intellectual property of SkyPenguinLabs and are licensed, not sold, to customers for personal, non-commercial use only. Reproduction, distribution, or public display of Content without express written permission is strictly prohibited. Purchases are final, with no refunds offered except where required by applicable law. We provide demonstration materials and samples solely to aid purchasing decisions; these materials may not be distributed or used for any purpose other than financial evaluation. While we strive for accuracy, all Content is provided "as is" without warranty of any kind, express or implied.
Consultation services, including personal course development, tutoring, and software engineering guidance, are subject to availability and separate scheduling agreements. Payment for all services may be processed through third-party platforms including cryptocurrency transactions; by using these payment methods, you agree to comply with their respective terms of service. Any personal information collected will be handled in accordance with our Privacy Policy and applicable data protection laws. Signed physical copies require additional shipping information as outlined on our website and are subject to separate shipping terms. All financial ledgers used for transactions, are validated as trustworthy ledgers - e.g: those run by PayPal, CashApp, Venmo or Solana and Ethereum.
This TOS is governed by the laws of the State of Florida and applicable United States federal law. Any disputes arising from these terms or use of our services shall be resolved exclusively in courts located in Florida. SkyPenguinLabs reserves the right to modify these terms at any time without notice, with continued use constituting acceptance of any modifications.
SkyPenguinLabs also reserves the right to remove, suspend, or terminate access to any Content, services, or user accounts, and to bar any activity within or around SkyPenguinLabs' platforms, products, services, or community spaces (including sponsored talks or cons). This includes, but is not limited to, the right to remove or prohibit:
(a) content that violates these Terms of Service or applicable laws
(b) content that infringes on intellectual property rights
(c) content deemed inappropriate, harmful, offensive, or disruptive
(d) unauthorized commercial solicitations or promotional materials
(e) attempts to reverse engineer, decompile, or otherwise extract source code from our products
(f) activities that compromise the security of our systems
(g) impersonation of SkyPenguinLabs staff or other users
(h) circumvention of any payment mechanisms
(i) creation of multiple accounts to abuse services ( we track it ALL :D, you are inside of completely custom infrastructure )
(j) harassment of other users or staff; Including intent to damage reputation of our contributors
(k) sharing of access credentials or documents
(l) Attempting to socially disrupt marketing campaigns run by SPL, sub-companies of SPL, or brands associated with SPL
Finally, (x) any activity that interferes with or disrupts the functionality, operation, or integrity of SkyPenguinLabs' services.
SkyPenguinLabs maintains the exclusive right to determine what constitutes a violation warranting removal or prohibition. Such determinations are final and not subject to appeal. We are under no obligation to monitor all content or activities but may do so to ensure compliance with these Terms and applicable laws. SkyPenguinLabs shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from the removal of content or barring of activities. Users whose content is removed or activities are barred may be notified at SkyPenguinLabs' discretion, but failure to provide notice does not create any right or remedy for the affected user. By using our services, you acknowledge and agree that SkyPenguinLabs may exercise these rights without incurring any liability to you or any third party.
